V1BE Academy Terms and Conditions

‍

1. About us and these terms

1.1 These terms apply when you enrol on a course with V1BE Academy Ltd (“we”, “us”), a company registered in England and Wales with company number 17381753, registered office 75 Mosley Street, Manchester, England, M2 3HR. You can contact us at info@v1beacademy.com.

1.2 “You” means the person enrolling. You must be at least 16 years old to enrol.

1.3 Our contract with you starts when you pay the enrolment fee and we send you an email confirming your place. Please read these terms before you pay. When you enrol online you will be asked to tick a box to confirm you accept them.

1.4 We will send you a copy of these terms with your enrolment confirmation. Keep it for your records.

1.5 Nothing in these terms affects your legal rights as a consumer.

2. The course

2.1 The course is the Active IQ Level 2 Fitness Coach qualification followed by the Active IQ Level 3 Personal Trainer qualification. It includes:

  1. access to our online learning platform for 12 months from enrolment
  2. tutor support by email, and around 20 hours of one to one sessions with a tutor across the course
  3. a monthly business training day and a monthly webinar
  4. practical and theory assessments, and your Active IQ registration and certification fees
  5. a self employed placement offer, as set out in section 5

2.2 Most learners finish in 3 to 6 months. How long it takes depends on you. If you have not finished when your access ends, you can ask us to extend it for a fee of £150.

2.3 We may update course content, tutors or session dates to keep the course current or meet Active IQ requirements. We won’t make changes that reduce what you get overall.

2.4 If we can no longer provide the course, we will tell you as soon as possible and refund the fees you have paid for any part of the course you have not received.

3. Fees and payment plans

3.1 The course fee is £1,350 if you pay in full, or £1,366 on the payment plan. Both prices include VAT.

3.2 You can pay either:

  1. in full when you enrol, £1,350; or
  2. by payment plan: a £25 enrolment fee when you enrol, then 9 monthly payments of £149. The first monthly payment is taken 30 days after you enrol, then on the same date each month. The total is £1,366.

3.3 The payment plan includes a £16 admin fee for spreading the cost over 9 months. There is no interest. The £25 enrolment fee is part of the course fee, not an extra charge.

3.4 Payments are taken by card or Direct Debit through our payment provider, Stripe. By enrolling on the payment plan you authorise us to take each payment automatically on its due date. You will get a receipt by email for every payment.

3.5 By enrolling, you agree to pay the course fee. If you cancel or leave, what you owe is set out in section 4. Your placement offer is set out in section 5.

3.6 You can pay off the remaining balance early at any time, at no extra cost.

Missed payments

3.7 If a payment fails, our payment provider will try again automatically and email you. Please update your card or bank details using the link in that email.

3.8 If a payment is still unpaid 14 days after its due date, we may pause your access to the learning platform, tutor support and assessments until your account is up to date.

3.9 If payments are still unpaid 30 days after their due date, we may end your access to the course. The unpaid payments remain owed, and we may pass the debt to a collection agency.

3.10 We do not charge late payment fees or interest.

3.11 Your Active IQ certificates are claimed upon course completion. We hold the right to withhold your certificate if your course fee is not paid in full, and we only make a placement offer under section 5 while your account is up to date.

4. Cancelling or leaving the course

Your 14 day right to cancel

4.1 Because you enrol online, you have a legal right to cancel within 14 days of the day we confirm your place, for any reason.

4.2 If you ask us to give you access to the course straight away, and then cancel within the 14 days, we will refund what you have paid minus a fair amount for the course you have already received (for example, tutor sessions you have had and Active IQ registration fees we have already paid for you). If you have not started the course, you get everything back.

4.3 To cancel, email us at info@v1beacademy.com or use the cancellation form at the end of these terms. We will refund you within 14 days of hearing from you, using the same method you paid with.

Leaving after the 14 days

4.4 After the 14 days, you can still leave the course at any time by emailing us. What you owe depends on how far through the course you are:

  1. If you leave before you complete any Level 2 assessments, you owe £400, covering your enrolment, Active IQ registration, platform access and tutor time.
  2. If you leave after you complete Level 2 but before you start Level 3 assessments, you owe £850.
  3. If you leave after you start Level 3 assessments, you owe the full course fee.

4.5 If you have paid more than you owe, we will refund the difference within 14 days. If you have paid less, your remaining payments continue until you have paid what you owe, then stop.

4.6 If you need to pause your studies for a good reason, such as illness or a family emergency, talk to us. We will try to agree a break and extend your access where we can.

5. Your placement offer

5.1 Once you qualify, we will offer you a self employed personal trainer placement at a NAPTP partner gym within 25 miles of the home postcode you gave us when you enrolled. We will make this offer within 30 days of the date your Level 3 result is confirmed.

5.2 We will make this offer if:

  1. we confirmed before you enrolled that a partner gym is within 25 miles of your postcode (if you move, tell us and we will check your new postcode, but we can only make an offer in the new area if we agree this in writing)
  2. you pass the course within 12 months of enrolling
  3. your course payments are up to date
  4. you have what you need to work as a self employed PT: valid insurance and the right to work in the UK
  5. you reply to the placement offer and attend an introduction at the gym within 7 days of the offer

5.3 The placement is a self employed arrangement on the gym’s standard terms. You pay the gym a monthly rent (currently around £497 on average, with the first 6 weeks rent free). Your clients pay you directly. We do not guarantee how many clients you will have or how much you will earn.

5.4 If we cannot make an offer that meets section 5.1 within 30 days, we will keep looking for a suitable placement for you for up to 3 months and update you at least every 2 weeks. Course fees are not refunded if a placement is not offered.

5.5 We will not make a further offer if you turn down an offer that meets section 5.1, or if you leave the course or your access is ended under section 3.9.

5.6 This section does not affect your legal rights.

6. Assessment, certification and responsibilities

Assessment and certification

6.1 Your qualifications are awarded by Active IQ, an Ofqual regulated awarding organisation. You must pass every assessment to qualify. Assessments are marked by our assessors and checked under Active IQ’s rules.

6.2 If you don’t pass an assessment first time, you can resit it 2 times free of charge. Any extra resits are subject to a £30 charge each.

6.3 If you need reasonable adjustments to an assessment because of a disability or learning need, tell us before you start so we can arrange them.

6.4 All work you submit must be your own. Copying, or submitting work produced by someone else or by AI tools as your own, can lead to your work being rejected and may be reported to Active IQ.

Your responsibilities

6.5 You agree to:

  1. give us accurate information when you enrol, including your postcode and any health conditions relevant to practical sessions
  2. keep your login details private and not share course materials with anyone else
  3. treat tutors, assessors, other learners and practice clients with respect
  4. follow health and safety guidance during practical sessions and at V1BE Gym

6.6 Course materials are our property or licensed to us. You may use them for your own study only.

Our responsibilities

6.7 We will provide the course with reasonable care and skill, as described in these terms.

6.8 We are not responsible for losses that were not foreseeable, for loss of business or earnings, or for delays caused by events outside our control. If we break these terms, our liability to you is limited to the course fees you have paid.

6.9 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

7. Complaints, personal data and general terms

Complaints and appeals

7.1 If you are unhappy with any part of the course, email us at info@v1beacademy.com. We will reply within 5 working days and aim to resolve your complaint within 20 working days.

7.2 If you disagree with an assessment decision, you can appeal by emailing us at info@v1beacademy.com. If you are still unhappy after our process, you can take it to Active IQ.

Your personal data

7.3 We use your personal data to run the course, take payments, register you with Active IQ and arrange your placement. We share it only with those who need it for these purposes, including Active IQ, our payment provider and the partner gym for your placement. Our privacy policy explains how we handle your data and your rights under UK data protection law.

General

7.4 We may update these terms from time to time. The terms in force when you enrolled apply to your course unless a change is needed by law, in which case we will tell you.

7.5 If a court decides part of these terms is not valid, the rest still applies.

7.6 These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
